Terms of Service
Last updated: [date]
1. Agreement
These Terms govern your use of Stampede, provided by [Your Company Name] (“we”, “us”). By creating a business account, you agree to these Terms and our Privacy Policy.
2. What Stampede is
Stampede lets a business create digital stamp/loyalty cards that customers can add to Apple Wallet or Google Wallet, and gives the business a dashboard to manage members and track activity.
3. Your account
- You must provide accurate information when signing up and keep your login credentials confidential.
- You're responsible for activity that happens under your account, including stamps given by your staff.
- You're responsible for the content you add to your loyalty card (reward description, branding, terms shown to your members).
4. Your members' data
You are responsible for having a lawful basis under POPIA to collect and process your own customers' personal information (for example, obtaining their consent when they join your loyalty card), and for honouring any requests from your members to access, correct, or delete their data. We process that data on your behalf as described in our Privacy Policy.
5. Acceptable use
You agree not to:
- Use Stampede for any unlawful purpose.
- Attempt to access another business's account or data without authorisation.
- Interfere with or disrupt the service (e.g. attempting to overload or hack it).
- Use the platform to collect personal information from people who have not knowingly joined your loyalty card.
6. Fees and billing
[Describe your pricing/billing terms here once billing is set up — e.g. monthly subscription amount, billing cycle, what happens on non-payment, and refund policy.]
7. Cancellation and suspension
You may stop using Stampede at any time. We may suspend or terminate an account that breaches these Terms, engages in unlawful activity, or is inactive for an extended period, after reasonable notice where practical.
8. Availability and support
We aim to keep Stampede available and reliable, but we don't guarantee uninterrupted access. We'll do our best to notify you of planned maintenance or known outages.
9. Limitation of liability
To the fullest extent permitted by law, [Your Company Name] will not be liable for indirect, incidental, or consequential damages arising from your use of Stampede. Our total liability for any claim relating to the service is limited to the amount you paid us in the [3/6/12] months before the claim arose.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of the South African courts.
